According to international declarations “Open Access Initiative Budapest” and “Berlin Declaration on Open Access to Knowledge in the Sciences and Humanities”, universities, research centers and institutions, whose core activity the research itself, should seek to offer open access to their research, especially those financed by the government. in this paper, we discuss the issue of data and documents that serve as input for the development of research which should also be available in open access. The objective of this paper is to present the access to public information and open access to research, differentiating them and establishing their convergence. It presents content analysis of Brazilian legislation relevant to the topic. The paper presents a theoretical discussion on access to public information and open access to research, including their state of the art, characterized by discussion of open access to data and documents of the research process. Establishes convergence fragments of Brazilian law with respect to data access, information and documents produced by scientific institutions. It offers a hint of minimum standards for the management of documents and research data to facilitate their use.
