Este artigo tem como objetivo apresentar o processo de justiça de transição no Brasil relacionado aos arquivos, aos tramites judiciais e às comissões da verdade. Reflete-se sobre o tratamento dado pelo Estado e particularmente pelo judiciário, assim como por setores da sociedade civil organizados, à investigação e a responsabilização por crimes considerados graves violações de direitos humanos. O “direito de saber”, que posteriormente ficaria conhecido como direito à verdade relaciona diretamente o processo judicial ao direito à justiça e à proteção e garantia de acesso a arquivos.
This article aims to present the transitional justice process in Brazil related to archives, judicial processes and truth commissions. That is, as investigation and accountability for crimes committed, considered serious violations of human rights were treated by the State, the judiciary and organized civil society sectors, from the perspective of the right to memory and truth. The “right to know”, which would later become known as the right to the truth relates directly the judicial process to the right to justice and the protection and guarantee of access to archives.
