Em 2011, após vinte anos da publicação da Lei n. 8.159/1991, a Primeira Conferência Nacional de Arquivos - I CNARQ reuniu especialistas de todo o país para discutir a política nacional de arquivos, mediante a revisão de seus marcos legais e da atuação do Arquivo Nacional e do Conselho Nacional de Arquivos – CONARQ. O presente artigo objetiva apresentar as condições da criação da Lei de Arquivos, bem como verificar as pertinências e contradições de seus dispositivos; explanar sobre o emprego da Lei n. 8.159/1991 pelo Arquivo Público do Estado (SP), órgão central do Sistema de Arquivos do Estado de São Paulo – SAESP, enquanto importante ferramenta para implementar a política estadual de arquivos, gestão documental e acesso à informação; analisar as ações do Arquivo Público do Estado enquanto participante ativo tanto dos trabalhos da I CNARQ quanto das tentativas que se seguiram junto ao CONARQ para concretizar as decisões da Conferência.
The actions of the São Paulo State Public Archivesin the implementation and revision of the National Archives Act (BR)

In 2011, twenty years after the publication of the Law no. 8,159/1991, the First National Archives Conference- I CNARQ brought together experts from across the country to discuss the national archives policy, by re-viewing their legal frameworks and the role of the National Archives and of the National Council of Archives – CONARQ. This article aims to present the conditions for the creation of the National Archives Act as well as well as verifying the pertinences and contradictions of its legal provisions; to explain about the use of the Law no. 8,159/1991 by the State Public Archives (SP), central body of the São Paulo State Archives System – SAESP, as an important tool to implement the state policy on archives, document management and ac-cess to information; to analyze the actions of the State Public Archives (SP), as an active participant both in the work of the I CNARQ and in the attempts that followed with the CONARQ to realize the Conference’s decisions.
