Este artigo pretende analisar três escopos legais de estruturação do Arquivo Histórico de Joinville (AHJ): a Lei Municipal n.º 1.182/1972, que o instituiu; a Lei n.° 7.992/2015, que o reformulou; e o Regimento Interno, publicado pela Portaria n.° 099/2015, que descreve suas responsabilidades e competências. A primeira legislação foi justificada a partir do Compromisso de Brasília (1970), as subsequentes incorporaram os processos legais estabelecidos para o patrimônio arquivístico nacional nos anos 90 e 2000. Em 2022, à luz das comemorações do Cinquentenário do AHJ, optou-se por problematizar essas questões legais para contribuir com o debate público nos campos da História e da Arquivologia, especialmente com base nas impessoalidades legais generalizadas de quem é quem nas composições e atribuições dos acervos arquivísticos. Assim, vislumbra-se identificar possíveis valores histórico atribuídos ao AHJ pelos idealizadores e pelos técnicos, em distintas fases. A metodologia de análise pretende analisar o texto legal e o processo de reorientação atributiva conforme as novas normativas legais do campo arquivístico. O artigo, finalmente, pretende contribuir para a importância de se repensar a gestão dos arquivos públicos municipais e, sobretudo, refletir sobre as transformações históricas desses lugares de memória, tradicionalmente considerados estratégicos para a consagração de memórias regionais.

This article intends to analyze three juridical scopes of structuring the Historic Archive of Joinville (AHJ): the Municipal Law no. 1,182, of March 20, 1972, which established it; the Law no. 7,992, of May 20, 2015, which reformulated it; and the internal regulations published by Ordinance no. 099, of September 11, 2015, which established the responsibilities and capacities of the AHJ. The first legislation was justified from the Brasília Commitment (1970), and the subsequent ones incorporated the juridical processes established in the archival heritage in the 90s and 2000s. These juridical issues contribute to the public debate in the fields of history and archival science, above all, from the generalized juridical impersonality’s of who’s who in the compositions and attributions of archival collections. Based on this problem, we can identify possible historical values attributed to the AHJ by the creators and technicians. The analysis methodology intends to verify the juridical text and the process of attributive reorientation according to the new juridical norms of the archival field. Finally, it seeks to contribute to the importance of rethinking the management of municipal public archives and, above all, to reflect on the historical transformations of these places of memory, traditionally considered strategic for the consecration of regional memories.
