Este ensaio discute a relevância de algumas abordagens epistemológicas, éticas e políticas de Jürgen Habermas para a análise de práticas de justiça de transição. Como objeto da análise, parte-se da experiência do autor como consultor de um dos grupos de trabalho da Comissão Nacional da Verdade brasileira, que foi estabelecida pela Lei 12528/2011. A construção da análise é teórica e não empírica, portanto despreza para efeitos argumentativos os meandros das investigações, depoimentos, audiências públicas e outros mecanismos de pesquisa efetivamente usados pelos grupos de trabalho da Comissão Nacional da Verdade. O escopo da investigação é o papel da busca cooperativa da verdade, como empreendimento epistemológico, na consecução de elementos que favoreçam a reconciliação nacional e ao estabelecimento de um repertório hermenêutico capaz de criar condições para o entendimento mútuo, ante situações de superação de injustiças cometidas historicamente. O recurso à teoria de Jürgen Habermas é justificado, não apenas pela biografia deste autor, que se retroalimenta da necessidade histórica de reparação das injustiças cometidas pelo Nacional Socialismo na Alemanha, porém, sobretudo, pelas investigações sobre o papel da aprendizagem comunicativa como elemento restabelecedor de uma solidariedade construída em bases morais, de uma ética discursiva, que favorecem ao estabelecimento do Estado de direito e da democracia deliberativa. Neste sentido, a argumentação desenvolvida parte de constatações da Comissão Nacional da Verdade, se debruça sobre aspectos da ética do discurso, referentes à resolução de conflitos e se conclui com apreciações sobre o papel da justificação no estabelecimento da verdade.

Memory, truth and justice - building cooperative searching for the truth and mutual understanding: a philosophical view since a participation at the Brazilian Commission of Truth

This essay makes an overview on the relevance of Jürgen Habermas approaches on epistemology, ethics and politics to transition justice practices. The subject of this analysis receives inputs of the personal experience of the author as consultant of the National Commission of Truth, which was established by Law in Brazil. The repertoire of the analysis is theoretical; the arguments don’t reflect the actual work of the National Commission of Truth and their own researches. The main issue of this essay is build an understanding on the cooperative search for the truth, as an epistemological effort to achieve national reconciliation and to create an hermeneutical mutual understanding able to overcome historical injustices. Jürgen Habermas theoretical framework is justified, not just because his biography, which is remarked by the role of overcoming the historical injustices did by the National Socialism in Germany, but, overall, by the theoretical approaches of the role of the communicative learning as a tool to achieve solidarity build in moral basis, trough a discursive ethics, towards to a country based on the Rule of Law and the normativity of the Deliberative Democracy. The arguments are presented in three main steps, first talking on some aspects of the National Commission of Truth, thenlooking for some contribution of the discursive ethics to the issue, finally analyzing the role of justification to the truth as part of the pluralistic approach to conflict resolution.
